Mediation

Mediation involves the use of a neutral third party, the “mediator.” It is a dynamic, structured and interactive process where a neutral third party assists disputing parties in resolving conflict through the use of communication and negotiation techniques. The parties meet in a neutral location. Ideally, the parties will meet in one room, however if necessary, the parties will move to separate rooms and the mediator will go back and forth between the parties’ rooms, sharing information and relaying offers and responses. The goal of the mediator is to guide the parties into an agreement that is, if not optimal to any party, acceptable to all parties. All participants in mediation are encouraged to actively participate in the process.
